The following terms (“Terms of Use”) constitute an agreement between Dietitian HQ (“DHQ”) and you that governs your use of this website and all of its associated services, content, and functionality.

Your use of the Websites constitutes your acceptance of, and agreement to, the following Terms of Use. DHQ reserves the right to modify, alter, amend or update its Websites, policies and these Terms of Use. These Terms of Use are subject to change without notice. If you do not agree with or do not accept any part of these Terms of Use, you must not use the Website.

PURCHASE POLICIES
On the Websites, you may purchase digital products, such as courses, symposiums, ebooks, and memberships (“Products”).

Refund Policy
Refunds are not available for purchase of Products due to nature of digital goods.

Fee Policy
DHQ accepts payment via the current payment method indicated at time of purchase. which may include credit card, PayPal, and any other form of payment made available. You agree to abide by any relevant Terms of Service or other legal agreement whether with DHQ, PayPal, Stripe or another third party, that governs your use of a given payment processing method. You agree to pay for any Products that you order. All prices listed in United States Dollar (USD). DHQ will charge your credit card or other form of payment for the price listed on the relevant Products offer, along with any additional amounts relating to applicable taxes, bank fees, and international currency fluctuations. If you purchase any automatically renewing subscriptions or payment plans, you agree that DHQ will charge the payment method on file on the first day of each billing period for the relevant subscription, and if the payment method on file becomes invalid due to an expired credit card or other similar reason and we are unable to charge you on the next billing period, DHQ reserves the right to immediately revoke your access to any Products you have ordered until you update your payment method. If you fail to update your payment method within a reasonable amount of time, DHQ may cancel your subscription. You are solely responsible for all reversed or charged back transactions, regardless of the reason for, or timing of, the reversal or chargeback.

Subscription fees for the membership-based Products are recurring payments. The term may be monthly or annual, as described in the course of the transaction. Your subscription begins upon payment of a first installment of subscription fees. The subscription renews monthly or annually as applicable upon the payment of automatically recurring subscription fees. Monthly or annual fees are charged on the same day of the month that the subscription began. (For example, if a monthly subscription began on the 29th, 30th, or 31st day of a month, then membership will renew on the last day of any month that doesn’t have that many days.) When you subscribe to Products, you are committing to a monthly recurring charge on your credit card to continue membership. Once payment has been processed, it is non refundable. Cancelled memberships means that any future scheduled monthly recurring payment will not be processed, and will not be processed unless membership is resumed.

If DHQ is required to collect or pay any taxes in connection with your purchase of Products, such taxes will be charged to you at the time of each purchase transaction or other appropriate time as applicable. Additionally, if required by law, you are responsible for reporting and paying certain taxes in connection with your purchase and use of Products. Such taxes may include duties, customs fees, or other taxes (other than income tax), along with any related penalties or interest, as applicable to your purchase or country of purchase.

Confidentiality

By purchasing Products, you are acknowledging and agreeing to the DHQ non-disclosure agreement.

WHAT INFORMATION DO WE COLLECT AND HOW IS IT USED?

  • Google Analytics – this service tracks Website usage and provides information such as referring websites and user actions on the Website. Google Analytics may capture your IP address, but no other personal information is captured by Google Analytics. This Website has anonymized the collection of IP addresses through Google Analytics
  • Mailerlite – this service is used for delivery of email updates, newsletters, promotions, and course communication. Mailerlite stores your name and email address for purposes of delivering such communications.
  • Paypal – this service is used for payment processing on ecommerce products. At no time is your banking information passed to the Website. We receive only information used for order fulfillment and reporting.
  • Stripe – this service is used for payment processing on ecommerce products. At no time is your banking information passed to the Website. We receive only information used for order fulfillment and reporting.
  • Memberpress – the Website uses Memberpress to host its ecommerce application. When orders are placed through memberpress, the Website will store information about the purchase, including your name, address, email address, IP address and location. This information is used for order fulfillment. You may automatically receive certain correspondence from us related to your order, but your purchase will not automatically add you to any marketing email lists.
  • The Website may use other software to aid in processing and creation of contact forms, such as Mailerlite. These service providers pass information directly to the Website and nothing is stored on a third-party server as a result.

At this time, your personal information is not shared with any other third-party applications. This list may be amended from time to time in the Website’s sole discretion.

Except when required by law, DHQ will not sell, distribute, or reveal your email addresses or other personal information without your consent; however, DHQ may disclose or transfer personal information collected through the Website to third parties who acquire all or a portion of our business, which may be the result of a merger, consolidation, or purchase of all or a portion of our assets, or in connection with any bankruptcy or reorganization proceeding brought by or against us.

From time to time, DHQ may use anonymous data, which does not identify you alone, or when combined with data from other parties. From time to time, the Website may engage in remarketing efforts with third-party companies, such as Google, Facebook, or Instagram, in order to market the Website. These companies use cookies to serve ads based on someone’s past visits to the Website.

Sponsored Content Tracking Pixels
This Website may engage in sponsored campaigns with various influencer networks, brands, and agencies. All sponsored content is duly disclosed in accordance with the FTC’s requirements. From time to time, these sponsored campaigns utilize tracking pixels (aka web beacons), which may contain cookies to collect data regarding usage and audience. This information is collected by the sponsoring company to track the results of the campaign. As stated above, these pixels may capture your IP address on behalf of the content sponsor. No personally identifiable information collected by the Website is used in conjunction with these tracking pixels.

Affiliate Program Participation
The Website may engage in affiliate marketing, which is done by embedding tracking links into the Website. If you click on a link for an affiliate partnership, a cookie will be placed on your browser to track any sales for purposes of commissions.

DHQ is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and links to Amazon.com.  As part of this Amazon Associates program, the Website will post customized links, provided by Amazon, to track the referrals to their website. This program utilizes cookies to track visits for the purposes of assigning commission on these sales.

Newsletters
On the Website, you may subscribe to our newsletter, which may be used for advertising purposes. All newsletters sent may contain tracking pixels. The pixel is embedded in emails and allows an analysis of the success of online marketing campaigns. Because of these tracking pixels, DHQ may see if and when you open an email and which links within the email you click. Also, this allows DHQ to adapt the content of future newsletters to the interests of the user. This behavior will not be passed on to third parties.

RIGHTS RELATED TO YOUR PERSONAL INFORMATION

INDEMNITY

You agree to defend, indemnify and hold DHQ, its members, employees, officers, directors, managers and agents harmless from and against any and all losses, claims, suits, actions, liabilities, obligations, costs and expenses (including reasonable attorneys’ fees and expenses) which DHQ suffers as a result of third-party claims based on: (i) your negligence or intentional misconduct, (ii) your breach of any provision of the Terms of Use (including representation or warranty); (iii) materials prepared or provided by you including, but not limited to, any claims of infringement, or misappropriation of copyright, trademark, patent, trade secret, or other intellectual property or proprietary right, infringement of the rights of privacy or publicity, or defamation or libel; or (iv) death, personal injury, or property damage arising out of, or relating to, your obligations hereunder.

ARBITRATION

The Terms of Use will be governed and construed in accordance with the laws of the State of North Carolina. Any controversy or claim arising out of or relating to the Terms of Use, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The place of any such arbitration shall be in or near Guilford County, North Carolina. The parties also agree that the AAA Optional Rules for Emergency Measures of Protection shall apply to the proceedings.

MISCELLANEOUS PROVISIONS

If any provision(s) of the Terms of Use is held to be invalid, illegal or unenforceable, the remaining provisions shall be severable and enforceable. If a provision is excessively broad, such a provision shall be limited or reduced in scope so as to be enforceable.

The Terms of Use may not be assigned by you without DHQ’s prior written consent, however, the Terms of Use may be assigned by DHQ in its sole discretion.

The Terms of Use are the final, complete and exclusive agreement of the parties with respect to the Websites offered by DHQ.
